1. Introduction

Welcome to VUT (Video Uploading Tool), operated by TechCarrel. These Terms and Conditions govern your use of our video recording, storage, and sharing platform available at https://videouploadingtool.com. By accessing or using VUT, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our service.

2. Service Description

VUT is a video recording and sharing platform that enables users to:

  • Record screen and webcam videos
  • Connect third-party cloud storage services (Google Drive, OneDrive, Dropbox)
  • Upload and store videos in their own cloud storage
  • Generate shareable links for their videos
  • Manage video privacy and access controls

VUT acts as a facilitator and does not store the actual video files. All videos are stored in the user's connected cloud storage accounts.

3. Account Registration and Eligibility

3.1 Account Creation

  • You must create an account to use VUT services.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years of age to use this service.

3.2 Account Security

  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access or security breach.
  • TechCarrel is not liable for any loss or damage arising from your failure to maintain account security.

4. User Responsibilities

4.1 Content Ownership

  • You retain all ownership rights to the videos you create and upload.
  • You are solely responsible for the content you record, upload, and share.
  • You must have all necessary rights, licenses, and permissions for any content you upload.

4.2 Prohibited Content

You agree not to upload, share, or create content that:

  • Violates any applicable laws or regulations
  • Infringes upon intellectual property rights of others
  • Contains malware, viruses, or malicious code
  • Is defamatory, obscene, pornographic, or hateful
  • Promotes violence, discrimination, or illegal activities
  • Violates the privacy rights of others
  • Contains personal information of minors without proper consent

4.3 Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the service or servers
  • Use automated systems to access the service without permission
  • Reverse engineer or attempt to extract source code from our platform
  • Resell or redistribute the service without authorization

5. Cloud Storage Integration

5.1 Third-Party Services

  • VUT integrates with Google Drive, OneDrive, and Dropbox through official APIs.
  • You must authorize VUT to access your cloud storage accounts.
  • VUT will only access files and folders necessary to provide the service.
  • You can disconnect cloud storage at any time through your account settings.

5.2 Storage Responsibility

  • Videos are stored in your connected cloud storage accounts.
  • You are responsible for managing your cloud storage space and quota.
  • TechCarrel is not responsible for data loss due to cloud storage failures.
  • You must maintain active subscriptions with your cloud storage providers.

5.3 Data Access

VUT stores video metadata and reference IDs only. Actual video files remain in your cloud storage. You maintain full control over your cloud storage files.

6. Video Sharing and Privacy

6.1 Sharing Controls

  • You can set videos as public or private.
  • Private videos can be password-protected.
  • You can set expiration dates for shared links.
  • You control who can view or download your videos.

6.2 Public Videos

  • Public videos may be accessed by anyone with the link.
  • You are responsible for ensuring appropriate content in public videos.
  • TechCarrel is not responsible for how others use or share your public links.

6.3 Content Removal

  • You can delete your videos at any time.
  • Deleted videos will be removed from VUT's system but may remain in your cloud storage until you delete them there.

7. Intellectual Property

7.1 VUT Platform

  • The VUT platform, including its design, features, and functionality, is owned by TechCarrel.
  • Our trademarks, logos, and brand elements are protected intellectual property.
  • You may not use our intellectual property without express written permission.

7.2 User Content

  • You retain ownership of your videos and content.
  • By using VUT, you grant us a limited license to process, display, and facilitate sharing of your content as necessary to provide the service.
  • This license terminates when you delete your content or account.

8. Service Availability and Modifications

8.1 Service Changes

  • We reserve the right to modify, suspend, or discontinue any part of the service at any time.
  • We may update features, change pricing, or alter functionality with reasonable notice.
  • We are not liable for any modification, suspension, or discontinuation of the service.

8.2 Maintenance

  • We may perform scheduled maintenance that temporarily limits service availability.
  • We will attempt to provide notice for planned maintenance when possible.

9. Pricing and Payment

9.1 Current Model

VUT is currently free to use during the beta/MVP phase. We reserve the right to introduce paid subscription plans in the future.

9.2 Future Pricing

  • If we introduce paid plans, we will provide advance notice to existing users.
  • Pricing details will be clearly communicated before any charges apply.
  • You may cancel your account before any paid plans take effect.

10. Termination

10.1 By You

  • You may delete your account at any time through account settings.
  • Upon account deletion, your metadata will be removed from our systems.
  • Videos in your cloud storage will remain until you delete them directly.

10.2 By TechCarrel

  • We may suspend or terminate your account if you violate these Terms and Conditions.
  • We may also suspend if you engage in fraudulent or illegal activities, abuse the service, or fail to comply with policies.

10.3 Effect of Termination

  • Your access to VUT will cease immediately.
  • Your data and metadata will be deleted from our systems.
  • Videos in your cloud storage remain your responsibility.

11. Disclaimers and Limitations of Liability

11.1 Service Provided "As Is"

  • VUT is provided on an "as is" and "as available" basis.
  • We make no warranties regarding service reliability, accuracy, or fitness for a particular purpose.
  • We do not guarantee uninterrupted or error-free service.

11.2 Third-Party Services

  • We are not responsible for failures of third-party cloud storage providers.
  • We are not liable for data loss due to cloud storage issues.
  • You should maintain backups of important content.

11.3 Limitation of Liability

  • To the maximum extent permitted by law, TechCarrel is not liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you for the service in the past 12 months.
  • We are not liable for data loss, business interruption, or lost profits.

11.4 User Content Liability

  • You are solely responsible for your content and how it is shared.
  • We are not liable for copyright infringement or legal issues arising from your content.
  • We are not responsible for unauthorized access to your shared videos.

12. Indemnification

You agree to indemnify and hold harmless TechCarrel, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms and Conditions
  • Your violation of any rights of others
  • Content you upload, share, or distribute through VUT

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using VUT, you also agree to our Privacy Policy.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and Conditions are governed by the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these terms or your use of VUT shall be subject to the exclusive jurisdiction of the courts in Gwalior, Madhya Pradesh, India.

14.3 Dispute Resolution

  • We encourage resolving disputes amicably through direct communication.
  • You agree to attempt informal resolution before pursuing legal action.

15. General Provisions

  • Entire Agreement: These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and TechCarrel regarding VUT.
  • Severability: If any provision is found to be unenforceable, the remaining provisions will remain in full effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not transfer or assign your rights under these terms. We may assign our rights to any affiliate or successor.
  • Changes to Terms: We may update these Terms and Conditions from time to time. We will notify you of material changes via email or service notification. Continued use after changes constitutes acceptance of new terms. The "Last Updated" date will reflect the most recent revision.
